The Nyne is an AI-powered advisory platform designed specifically for real estate professionals. The Service provides access to a suite of nine specialized AI executives who offer strategic guidance, financial analysis, marketing insights, and operational recommendations based on information you provide during onboarding and ongoing interactions.
The Service is designed to augment your decision-making process, not replace professional judgment. All advice provided is for informational purposes and should be evaluated in the context of your specific business circumstances.
3.1 Subscription Plans: The Nyne offers multiple subscription tiers with varying features and pricing. Your subscription will automatically renew on a monthly or annual basis, depending on the plan you select, unless canceled before the renewal date.
3.2 Payment Processing: All payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method for the applicable subscription fee and any applicable taxes.
3.3 Cancellation: You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period. No refunds will be provided for partial billing periods.
3.4 Price Changes: We reserve the right to modify subscription pricing with 30 days' notice. Price changes will not affect your current billing period.

5.1 Platform Ownership: The Nyne platform, including its software, design, AI models, prompts, and content, is the proprietary property of Elavare Holdings and is protected by copyright, trademark, and other intellectual property laws.
5.2 Your Data: You retain all ownership rights to the data you provide to the platform, including your onboarding responses, business information, and queries. We will not sell or share your proprietary business data with third parties except as required to provide the Service or as required by law.
6.1 Not Professional Advice: The Nyne provides strategic insights and recommendations generated by AI. This Service is NOT a substitute for professional legal, financial, tax, or accounting advice. You should consult with licensed professionals before making significant business decisions.
6.2 No Guarantees: While we strive to provide accurate and valuable insights, we make no guarantees regarding specific business outcomes, revenue increases, or transaction closures resulting from use of the Service.
6.3 AI Limitations: AI-generated advice may occasionally contain errors, inconsistencies, or outdated information. You are responsible for verifying all recommendations before implementation.
To the fullest extent permitted by law, Elavare Holdings shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost revenue, or lost business opportunities, arising from your use of or inability to use the Service. Our total liability for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
We reserve the right to suspend or terminate your access to the Service at any time for violation of these Terms, fraudulent activity, or other conduct we deem harmful to the platform or other users. Upon termination, your right to use the Service will immediately cease, and we may delete your account data in accordance with our data retention policies.
We may modify these Terms at any time. Material changes will be communicated via email or through the platform. Continued use of the Service after changes take effect constitutes acceptance of the modified Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in Arizona.
